THIS AGREEMENT GOVERNS YOUR USE OF OUR SERVICES.
BY ACCEPTING THIS AGREEMENT, EITHER BY REGISTERING ON www.jaazus.com OR BY EXECUTING AN ORDER FORM OR ANY OTHER DOCUMENTATION THAT REFERENCES THIS AGREEMENT, YOU AGREE TO THE TERMS OF THIS AGREEMENT. IF YOU ARE ENTERING INTO THIS AGREEMENT ON BEHALF OF A COMPANY OR OTHER LEGAL ENTITY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND SUCH ENTITY AND ITS AFFILIATES TO THESE TERMS AND CONDITIONS, IN WHICH CASE THE TERMS “YOU” OR “YOUR” SHALL REFER TO SUCH ENTITY AND ITS AFFILIATES. IF YOU DO NOT HAVE SUCH AUTHORITY, OR IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, YOU MUST NOT ACCEPT THIS AGREEMENT AND MAY NOT USE THE SERVICES.
The following definitions and rules of interpretation apply in this Clause.
“Agreement” means this Terms of service.
“Term” means the duration of the provision of the Services.
“Representatives” means either Party’s employees, officers, representatives, advisers or subcontractors involved in the provision or receipt of the Services.
“Permitted User” means an employee or Contractor of Customer or its Affiliate who is authorized to access the Service.
“Services” means JaaZus proprietary software-as-a-service solution(s), including the JaaZus Code, Dashboard and Application, as described in the applicable Order Form.
“Third-Party Platform” means any software, software-as-a-service, data sources or other products or services not provided by JaaZus that are integrated with Services.
“We”, “Us” or “Our” means JaaZus (A product of Longwood Infotech Private Limited)
“You” or “Your” means the company or other legal entity for which you are accepting this Agreement, and Affiliates of that company.
“Account” means JaaZus account created by You.
“User” means an individual who is authorized by You to use a Service, for whom You have purchased a subscription (or in the case of any Services provided by Us without charge, for whom a Service has been provisioned), and to whom You (or, when applicable, Us at Your request) have supplied a user identification and password (for Services utilizing authentication). Users may include, for example, Your employees, consultants, contractors and agents, and third parties with which You transact business.
“Security Features” means any security feature, including any encryption, pseudonymisation, key, PIN, password, token or smartcard.
“Standard Contractual Clauses” means the contractual clauses dealing with the transfer of Personal Data outside the EEA, which have been approved by (i) the European Commission under Data Protection Legislation, or (ii) by the ODPC or an equivalent competent authority under Data Protection Legislation. You will (a) be responsible for Users’ compliance with this Agreement, (b) be responsible for the accuracy, quality and legality of Your Data (as defined below) and the means by which You acquired Your Data, (c) use commercially reasonable efforts to prevent unauthorized access to or use of Services and content, and notify Us promptly of any such unauthorized access or use, (d) use Services and content only in accordance with this Agreement and applicable laws and government regulations.
You will not (a) make any Service or content available to, or use any Service or content for the benefit of, anyone other than You or Users, unless expressly permitted by us, (b) sell, resell, license, sublicense, distribute, make available, rent or lease any Service or content, or include any Service or content in a service bureau or outsourcing offering, (c) use our Service to store or transmit infringing, libelous, or otherwise unlawful or tortious material, or to store or transmit material in violation of third-party privacy rights, (d) use our Service to store or transmit Malicious Code, (e) interfere with or disrupt the integrity or performance of any Service or third-party data contained therein, (f) attempt to gain unauthorized access to any Service or content or its related systems or networks, (g) permit direct or indirect access to or use of any Service or content in a way that circumvents a usage limit, or use any of Our Services to access or use any of Our intellectual property except as permitted under this Agreement, (h) copy a Service or any part, feature, function or user interface thereof, (i) copy content except as permitted herein, (j) frame or mirror any part of any Service or content, other than framing on Your own intranets or otherwise for Your own internal business purposes or as permitted under this Agreement, (k) access any Service or content in order to build a competitive product or service or to benchmark with any product or service, or (l) reverse engineer any Service. Any use of the Services in breach of this Agreement, by You or Users that in Our judgment threatens the security, integrity or availability of Our services, may result in Our immediate suspension of the Services, however We will use commercially reasonable efforts under the circumstances to provide You with notice and an opportunity to remedy such violation or threat prior to such suspension.
Following activity is prohibited on our platform and we shall actively suspend accounts if they are found:
Neither these Terms nor use of the Services grants you ownership in the Services or the Content you access through the Services (other than your Content). Nothing on the Website should be construed as granting any license or right to use any trademarks, trade names, logos, or any other brand element displayed on the Website, unless you have been granted explicit written permission to use the same.
If you enable any third-party applications for use in conjunction with our Services, you acknowledge that JaaZus may allow such providers, access to your data. JaaZus will not sell your data to any third-party applications.
JaaZus, will no longer be accountable for any disclosure, amendment or deletion of your data, as a result of such access by third-party applications, thereupon.
Neither party will use or disclose the other party’s Confidential Information without the other’s prior written consent except for the purpose of performing its obligations under this Agreement or if required by law, regulation or court order; in which case, the party being compelled to disclose Confidential Information will give the other party as much notice as is reasonably practicable prior to disclosing the Confidential Information.
You will have and abide by an appropriate Privacy Policy that clearly dictates all your rights to your personal information and will comply with all applicable laws, policies, and regulations. You must not circumvent any privacy features (e.g., an opt-out) that are part of the Service.
We acknowledge that all intellectual property rights in Your Data are and will remain the property of You and/or the relevant Data Subjects, as the case may be; and that We shall have no rights in or to Your Data other than the right to Process it for the purposes set out in this Agreement. You reserve the right to access, modify, delete and transfer Your Data. Please refer to our DPA document to learn more about our Commitment towards your data.
We have put the pricing plans on the website, which may be changed from time to time.
Prices are in INR/USD and excludes any Service charges and Tax.
We provide Lifetime account meaning you signup and use for Lifetime of the application.
We don't provide refund.
We provide Free Lifetime account and you pay only for the Premium features.
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either Parties.
You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time and/or accordingly may deny you access to our Services (or any part thereof).
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EXCEPT AS EXPRESSLY PROVIDED FOR IN THIS AGREEMENT, JaaZus, MAKES NO OTHER WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE AND NON-INFRINGEMENT.
To the extent permitted by applicable law, JaaZus or Longwood Infotech Private Limited, will not be liable for your lost revenues or indirect, special, incidental, consequential, exemplary, or punitive damages, even if JaaZus, or its subsidiaries and affiliates have been advised of, knew, or should have known that such damages were possible, and even if direct damages do not satisfy a remedy.
If you are not satisfied with the Service, your only remedy will be to terminate your agreement at any time by notifying us that you no longer wish to use our Services.
To the extent permitted by law, You agree to indemnify, defend and hold harmless JaaZus or Longwood Infotech Private Limited and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, from and against any and all claims, costs, damages, losses, liabilities and expenses (including reasonable attorneys’ fees and costs made by any third-party ) arising out of any breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
The parties hereto are independent contractors. Nothing in this Agreement will be construed to create a partnership, joint venture, franchise, fiduciary, employment or agency relationship between the parties.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. We will notify any changes in the Terms of Service by sending an email to the email address you had given account creation. You are liable to check this page on a periodic basis to know the changes. Your continued use of or access to our website or the Services following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
In the event of any conflicts between foreign law, rules, and regulations, the governing law shall prevail.
Each party agrees to submit to the exclusive and personal jurisdiction of the Courts located in Udumalpet, India
The United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transactions Act do not apply to this Agreement.

This Privacy Policy specifies the types of personal data JaaZus, obtains through the JaaZus.com website, our product, and services offered by us, how we may use that personal information, with whom we may share it and how you may exercise your rights relating to our processing of that data. The Privacy Policy additionally describes the measures we take to secure your personal data and how you can contact us to learn more about our privacy practices.
This Privacy Policy applies to all the products, services, websites and apps offered by JaaZus, and its affiliates/partners, except where otherwise specified.
References to “data” in this Privacy Policy relates to whatever data you collect using our services, including the responses you receive from your Survey/Poll/Quiz/Reviews/Slides and the data you enter into our application in the form of email IDs and information of people to whom you send the Survey/Poll/Quiz/Reviews/Slides. We only process your personal data and at any and all times, the data belongs to you and you alone.
Your Survey/Poll/Quiz/Review/Slide data is yours. JaaZus, grants you the Admin role to collect and export the responses as you wish. We do not sell or use Survey/Poll/Quiz/Review/Slide responses collected by you for our business requirements.
We safeguard Survey/Poll/Quiz/Review/Slide respondents’ email addresses and the email addresses collected by you. We don’t use or sell the email addresses against our policy.
The security of your personal information and data is important to us. We store them securely. We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once it is received. We will process your Survey/Poll/Quiz/Review/Slide data on your behalf and under your instructions.
Survey/Poll/Quiz/Reviews/Slides are administered by Survey/Poll/Quiz/Review/Slide Creators. We host the Survey/Poll/Quiz/Reviews/Slides on our website or app and collect the responses that you submit to the Survey/Poll/Quiz/Review creators. If you have any questions about a Survey/Poll/Quiz/Review/Slide you are taking, please contact the Survey/Poll/Quiz/Review creator directly, as JaaZus is not responsible for the content of that Survey/Poll/Quiz/Review or your responses to it.
The anonymity of your responses depends on how the Survey/Poll/Quiz/Review/Slide creator has configured it.
We don’t sell or share your responses to third party advertisers or marketers. However, the policy might be different with the Survey/Poll/Quiz/Review creator. So you’re advised to check with them in this regard.
Registration information
When you register an account on www.jaazus.com, we collect your username, password, email address, IP, location, device and OS information.
Billing information
When you make a payment on www.jaazus.com in your preferred payment method, you’re required to provide billing details, such as a name, billing address, and financial information (like credit card details).
Account settings
You can set preferences on account settings page regarding your default language, branding, email, logo preferences.
Your users information
You can add email addresses into the "My Users" and make use of it for Closed Survey/Poll/Quiz/Reviews/Slides or to invite people to take part of your Survey/Poll/Quiz/Reviews/Slides. We don’t use the email addresses you have stored for our own purposes.
Your Survey/Poll/Quiz/Review/Slide data (questions, responses and users list) is stored with us.
Note: We don’t share or abuse your respondents’ email addresses. JaaZus will not email your Survey/Poll/Quiz/Review/Slide respondents or subscribers in your list except at your direction. We don’t sell or share the email addresses in your list to any third parties.
Event Logs
A log of all requests generated by the user is maintained to debug in case of any emergencies. This includes user information such as IP, location, OS information, browser, device type and the time which the user interacted with the platform. These log files are encrypted and rotated frequently.
JaaZus, may transfer Personal Data to the United States and/or to other third countries where JaaZus, or its processors operate (outside the European Economic Area “EEA”). JaaZus, will follow the requirements of these GDPR Terms regardless of where such Personal Data is stored or processed. We will take all steps reasonably necessary to ensure that Your Data is treated securely and in accordance with this Policy.
JaaZus gives utmost importance to the data privacy of its customers. In compliance with the GDPR regulation, JaaZus, hereby confirms upon the data privacy, security & transparency commitment, the company offers to all its customers.
We have an up-to-date Data Processing Agreement in place that elucidates our approach towards GDPR. We acknowledge that the GDPR will help us adopt the highest operational standards and will thereby facilitate to protect customer data in the best way possible.
Personal Privacy of customers’ data is absolute at JaaZus. While we will process customer data, it is the customer on whom the power to edit, delete, retain or transfer of data, fully rests upon.
Customers at any point in time can get in touch with us and conduct audits on their personal data. They can approach the Data Privacy Officer (DPO) by sending an email to privacy@jaazus.com and ask for any information pertaining to their account.
We promise to adopt utmost security standards so that your personal data does not get compromised at any point in time. We have tightened our IT infrastructure, data security platform & IT policies so as to offer our customers, enhanced end-to-end security.
JaaZus, stores user data with reference to your Service account. This may include personal information, Survey/Poll/Quiz/Review/Slide data and other details that you enter into the app from time to time. We will retain your data as long as you have an account with us. Upon termination or expiry of your account, we will delete all personal data including any copies thereof. In case, we are unable to delete your personal data due to technical or other reasons, JaaZus, will apply measures to ensure that your personal data is blocked from any further processing. This excludes the data that we are required to retain for audit purposes, even after deletion of your account.
Being the data owner, it is completely your call to decide on where & with whom your data must reside.
We do not use cookies.
We do not sell, trade, or otherwise, transfer to outside parties your Personally Identifiable Information. This does not include website or service hosting partners and other parties who assist us in operating our website or services, conducting our business, or serving our users, so long as those parties agree to keep this information confidential. We may also release information when its release is appropriate to comply with the law, enforce our site policies, or protect ours or others’ rights, property or safety.
Occasionally, at our discretion, we may include or offer third-party products or services on our website. These third-party sites have separate and independent privacy policies. We, therefore, have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.
Customers that fall under the EU-US Privacy Shield have certain legal rights to obtain information about how we handle your personal data. Some of these rights may be confined to some exceptions or special scenarios. However, at any point in time, you can raise your concern to privacy@jaazus.com and we will ensure to write back to you within a maximum of 15 business days.

The EU-U.S. and Swiss-U.S. Privacy Shield Frameworks were designed by the U.S. Department of Commerce, and the European Commission and Swiss Administration, respectively, to provide companies on both sides of the Atlantic with a mechanism to comply with data protection requirements when transferring personal data from the European Union and Switzerland to the United States in support of transatlantic commerce.
JaaZus, complies with the EU-US Privacy Shield Framework and takes responsibility of the personal data it receives/collects from its customers.
When it comes to collection of personal information from children under the age of 13 years, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, United States’ consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online.
Do we let third-parties, including ad networks or plug-ins, collect PII from children under 13?
We do not specifically market to children under the age of 13 years.
JaaZus, reserves the right to make changes to this Privacy Policy from time to time. We will post the revised version on the website along with the effective date. In case there are any material changes in the way we collect/handle your data, we will notify you about the policy changes via email. However, your continued use of our Services would imply your consent to the amendment of our Privacy Policy.
